These Terms of Service (“Terms”) govern your use of foundontop.com (the “Site”) and the free tools, forms, and messages provided by Get Found LLC, doing business as FOUND (“Found,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who may use the Site
You must be at least 18 years old and able to enter a binding agreement to use the Site or request our services.
2. Our services and client agreements
The Site describes our services for informational purposes. Any paid work, including the Get Found System, is governed by a separate written agreement between you and Found. If that agreement conflicts with these Terms, the written agreement controls. Guarantees described on the Site apply only as stated in, and subject to the conditions of, that written agreement.
3. Free tools
The Free Visibility Score is an estimate based only on your answers. It is not live Google data and is not a promise of results. The free Competitor Teardown reflects publicly available information at the time we prepare it. Search rankings and reviews change constantly and are controlled by third parties such as Google. Free tools are provided for information only and create no obligation for you or for us.
4. No guarantee of specific results
Examples, sample figures, and results shown on the Site, including results from businesses owned by Found’s founders, are illustrations. They are not a promise that you will achieve the same or similar results. Your results depend on your market, competition, business practices, and factors outside our control.
5. Intellectual property
The Site, including its text, design, graphics, logos, and code, is owned by Found or its licensors and is protected by copyright and trademark law. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, or distribute Site content without our written permission.
6. Acceptable use
You agree not to: submit false information or information about another person without their permission; interfere with or disrupt the Site; attempt to gain unauthorized access to any system; or use the Site for any unlawful purpose.
7. SMS terms (text messaging)
Program. If you opt in, FOUND will send you text messages about your Competitor Teardown, Visibility Score, scheduled calls, and our services, which may include marketing messages.
Consent. You opt in by checking the text message consent box on our forms or by texting us first. Consent is not a condition of any purchase. By opting in, you confirm you are the account holder or have the account holder’s permission for the phone number provided.
Frequency and cost. Message frequency varies. Message and data rates may apply.
Opting out. Reply STOP to any message to stop receiving texts. We will send one final message confirming you have been unsubscribed. You may opt back in at any time.
Help. Reply HELP for help, or contact us at getfound@foundontop.com or (321) 502-7037.
Timing. We send marketing texts only between 8:00 a.m. and 8:00 p.m. in the recipient’s local time.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Privacy. Your mobile information is handled according to our Privacy Policy. We do not sell or share your mobile number or text messaging consent with third parties for their marketing.
8. Third-party services and links
The Site may link to or use third-party services, such as Google, booking tools, and payment processors. We are not responsible for their content, policies, or performance.
9. Disclaimer
The Site and free tools are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, Found will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the Site or free tools. Our total liability for any claim related to the Site or free tools will not exceed one hundred dollars ($100).
11. Indemnification
You agree to indemnify and hold harmless Found and its owners, employees, and contractors from claims arising from your misuse of the Site or your violation of these Terms.
12. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to their jurisdiction.
13. Changes
We may update these Terms from time to time. The effective date at the top shows when they were last changed. Continued use of the Site means you accept the updated Terms.
